Charter your boat: Everything you need to know about the new temporary use change
Do you have a boat that you only use occasionally and have thought about making it profitable? The good news is that the future Royal Decree modifying merchant marine regulations will open new possibilities for recreational boat owners in Spain.
An opportunity for boat owners
The draft Royal Decree (in process as of January 2025) will allow a revolutionary change: boats registered in list 7 (private use) may temporarily switch to commercial use for a maximum of 3 consecutive months per year.
This means you can charter your boat and earn income when you’re not using it, as long as you meet a series of requirements.

10 key requirements to charter your boat
- Limited period: The use change will be for a maximum of 3 consecutive months per year.
- Professional management: Your boat must be managed by a nautical charter company or an entity qualified to assume this responsibility.
- Certificates in order: All your boat’s certificates must be valid.
- Technical inspections: Your boat must undergo the same inspections as list 6 boats (commercial use).
- Additional insurance: Besides mandatory liability insurance, you’ll need accident insurance covering all passengers.
- Express authorization: You must request dispatch authorization from the Maritime Authority at least 48 hours in advance.
- No jet skis: Jet skis are expressly excluded from this possibility.
- Only for nautical charter: The boat may only be used for nautical charter, not other commercial activities.
- Owner cannot operate: Neither you as owner nor related persons may operate the boat during the use change period.
- Hired skipper: The management company will be responsible for hiring the skipper if necessary.

To obtain use change authorization, you must present:
- ITB
- Seaworthiness certificate
- Navigation permit
- Liability insurance policy
- Accident insurance certificate for embarked persons
